San Antonio Safe & Sick Leave Ordinance
 
On Nov. 22, Judge Peter Sakai of the 225th District Court granted a Temporary Injunction, halting the City of San Antonio’s Sick and Safe Leave Ordinance which was to go into effect on December 1, 2019. 
 
The trial on the merits was held on, Dec 11 and Judge Sakai upheld the temporary injunction order, thereby staying the Safe & Sick Leave Ordinance from going into effect until after a trial date set for September 2020. The City appealed this decision on January 2.  We will keep members informed of any updates through this newsletter.
 
In response to the court's November 22 Injunction, Councilwoman Ana Sandoval submitted a Council Consideration Request (CCR) to City Council. The CCR includes the following for the Council to consider: 
 
  1. Requirement of compliance with Sick and Safe leave policy that meets or exceeds the requirements set forth in the Ordinance as adopted on Oct 17 for entities that receive operational funding from the City, including City-created non-profits, and establishment of a program to ensure compliance;
  2. Exploring adoption of a similar policy by CPS Energy and SAWS; and 
  3. Development of a Sick and Safe Leave Benefits Policy Outreach and Technical Assistance Program to encourage and assist San Antonio area employers in implementing a voluntary sick and safe leave policy in the workplace.  The details of the CCR can be found here.

 
 
USMCA Update and Call to Action
 
Senate Commerce Committee expected to vote week of January 15 on USMCA trade agreement
 
On December 10, U.S. Trade Representative Robert Lighthizer and his Canadian and Mexican counterparts signed a 27-page protocol of amendment to the United States-Mexico-Canada Agreement (USMCA) in Mexico City. This protocol was the outcome of several months of negotiations to address concerns about the agreement’s provisions relating to enforcement, labor, the environment, and intellectual property protections for biopharmaceuticals. The Canadian government also supported the protocol.
 
Senate negotiations on USMCA are ongoing. The Senate Finance Committee passed USMCA out of committee, 25-3 on Jan 7. The Senate Commerce Committee is expected to vote the week of Jan. 15 with the package to President Trump’s desk by mid-February.

With the support of nearly 700 organizations, the U.S. Chamber of Commerce sent an updated coalition letter to Capitol Hill this afternoon encouraging Congressional approval of the U.S.-Mexico-Canada Agreement (USMCA). View

National Federation of Independent Business (NFIB): Final DOL Joint-Employer Rule Provides Much-Needed Clarity for Small Business Owners
 
In response to the United States Department of Labor’s final rule that simplifies and updates its regulations that determine joint-employer status under the Fair Labor Standards Act, NFIB issued a statement from Karen Harned, Executive Director of the NFIB Small Business Legal Center.
 
 
Small Business Job Creation Remains Steady in December
Small business owners continued to hire employees, add new positions, and raise compensation in December, ending 2019 on a strong note, according to NFIB’s monthly jobs report.

The Unified Development Code (UDC) amendment process takes place once every 5 years. Amendments may be submitted for consideration and recommendation through various boards and commissions to UDCAmendments@sanantonio.gov  by May 1, 2020.
